DOLAN, Justice. This is an appeal from a decree, entered in the probate court for the county of Middlesex, denying a petition for the revocation of a decree of said court, dated January 20, 1937, allowing certain instruments purporting to be a will (dated December 5, 1934) and codicil (dated May 24, 1935) as the last will and testament of James D. P. Wingate (hereinafter called the testator), late of Medford in the county of Middlesex, who died on January 11, 1937, and who, up to that time, had been the owner of a majority of the shares of stock of the Medford Publishing Company.
